The false pretext: President loses a power grab strategy with Harvard, California, migrant due process rulings

The President is losing a power grab strategy with his action on Harvard, the deployment of military in California, and migrant due process ICE policies. The courts are not buying his use of pretexts to justify his actions.   Is Trump using false pretexts to justify military actions to seek regime change and revisit denied court actions, as he kills 11 Venezuelan drug sailors and floods the Caribbean with US military assets in a Wag the Dog scenario and reclassifies drug smugglers as "terrorists"? His most flagrant example of a false pretext is the misuse of revenge on Colorado's mail-in ballot system as a pretext for moving the space command center to Alabama. Trump has been trying to move the center since 2016, but had never tied it to mail-in ballots until now.

  One of the tools of terror to force institutions, private and public, to bend to Trump's power grabs is to use unrelated issues in order to get compliance with his policies and to justify anti-constitutional acts of withholding funding.  The pretext is false, and courts are not being fooled in recent lower court decisions. Most of these rulings will end up in the Supreme Court. (Oxford dictionary:Pretext: a reason given in justification of a course of action that is not the real reason.)  I would add that even the pretext itself can be used and abused and distorted, and it can be just as false as the issue and facts to which they are referring are false, as well.("False Pretense"is the word used in common language, but it also has a meaning  in the law closely associated with criminal real estate transactions so I am using "pretext" to avoid any confusion.)

Trump's attempt to force Harvard to change their curriculum and admissions polices, contrary to Trump's interests, by using the issue of anti-Semitism, just hit the fan.  A judge ruled that Trump's withholding of $2 billion in federal research grants unless Harvard complied with demands that were unrelated to anti-Semitism actions on campus was illegal. Judge says Trump administration unlawfully blocked $2 billion from Harvard | CNN Politics This ruling will be appealed, but in the meantime, the Trump strategy to scare all, including private institutions, engaged in higher ed that dare teach a liberal viewpoint, and the intellectual debate of multiple views, to change curriculum and staff to support his one-sided view, is being stopped.  Trump's attempt to control the ability of all Americans at any level of education to hear or learn views other than Trump is also obvious from attempts to force the Smithsonian to remove or reduce references to the ills of slavery in American history and the resulting civil rights movement. 

The grand daddy of false pretexts: to deploy military, national guard, or active duty contrary to the Posse Comitatus Act as applied to states' rights, is that there is a "national emergency", a loophole that would give him the power to do it. That one also was shot down in flames regarding the deployment of troops to California, and my also echo in other incidents, including his attempt to hype up the crime issue in blue states, when ignoring the even worse rate of crime in red states. After ruling against LA Guard use, Trump vows more deployments : NPR   Next on  Trump's plans: send troops into Chicago.  The use of federal troops in DC is a different situation, since Washington, DC, is not a state, but is subject to degrees of federal control and home rule.. It is obvious that such a declaration of national emergency serves his political ambitions to pull a trick out of the magic political hat." Democrats are always soft on crime, so fear them, and Republicans are hard-nosed." Watch that controversy to be on the top burner if Trump continues with plans in Chicago and Baltimore.

 So far, lower courts have ruled against the pretext of a "national emergency" as a means to circumvent the Constitutional provisions that Trump sees as standing in the way of his power grabs. Many of these rulings will likely be appealed to the Supreme Court.  The terms "abuse of power " and"overreach" are too kind. Recent cases are examples of power grabs by strong leaders who seek to wield the same powers as a dictator, ruling by one person who declares what the law is, rather than being established through a democratic process, subject to compliance and interpretations to justify Trump's real power grab attempts.

 As a recent example, Trump's order to move the space command from Colorado Springs to Alabama because Colorado defied his newest anti-voter access to the ballot box by mail. Trump says he's moving Space Command HQ to Alabama because of Colorado's mail-in voting system. This is purely a matter of revenge (against a blue state) to favor a supporter (red Alabama). In reality, the location of the space command has always been a matter of politics, since his first term, regardless of any financial or military considerations, and mail-in ballots were never linked to the move until now. The false pretext  Trump made in his announcement was not even disguised: He was moving it because of Colorado's mail-in system as retaliation.

 In fact, the anti-mail-in ballots argument rests on a false pretext itself.  There was widespread fraud, ballot harvesting, etc in 2020, caused by mail-in ballots, when nearly every opportunity in courts (at least a minimum of 60 court rulings), or for John Q Public to provide evidence in the past five years has failed.  Conservative group finds ‘absolutely no evidence of widespread fraud’ in 2020 election

Is he now planning military action against Venezuela (yes, we are at war now) to justify defying the Constitution clauses regarding due process and/or breaking international maritime laws and/or force regime change in that country?   Trump announced our military attacked a drug smuggling boat, and now he wants to get Venezuela's drug smugglers classified as terrorists, though, why? I suspect it is either to give legal cover to the US violating territorial waters, or to justify his illegal attempt to violate Venezuelan migrants' due process rights by zealous ICE action, already claiming Venezuela was at war with the US.  under the Alien Enemies Act.  An appeals court rejected the abuse of that act. US appeals court rejects Trump's use of Alien Enemies Act to deport Venezuelans | Reuters  For those engaged in conspiracy theories, it would not be put past Trump to declare the US was at war against Venezuela in order to take even more action against migrant mass deportation, regardless of whether they had committed any crimes. Secretary of State Marco Rubio from Florida has also had a long held desire to end the Maduro dictatorship. Wag the dog, the use of a false pretext for war can even itself be a false pretext. Inventing and provoking an incident is not just a strategy found in literature and movies.

Sometimes, the pretext to justify an action is not due to a scheme or grand plan, but sheer ignorance or perceived opportunity to make a point without knowing the facts. Within the same 24 hours, Trump confused 5-year-old videos with current facts, and AG Pam Bondi tried to cherry-pick examples of dangerous migrants in big blue cities, when the incidents did not happen in the city she claimed they did. It may also happen because Trump has only yes people advising him, who could intervene and correct him before he opens his mouth and sticks his foot in it. Here is an example of that: Trump, watching FOX, did not realize he was watching a 5-year-old video of George Floyd protests and claimed "last night" he saw Portland being destroyed, so it was time to threaten to send the military into the city and put that city on his list to try to oppress. Keeping track of Trump court cases: updated to 8/1/25

 Tracking the court actions and lawsuits over Trump’s agenda  

6/20/25 I once got into a tangle with a Trumpster regarding the importance of the rule of law. The response was a litany of all of the court rulings against Trump's interest, claiming the anti-Trump decisions, from the 2020 stolen elections to now, were because the judges were all liberal... despite rulings by Reagan and Trump appointees. Yesterday, two court decisions were particularly significant: one upheld the federal government's right to use National Guard troops without the state governor's approval, as seen in the recent California case. The other went against the attempt by the Trump administration to withhold already approved funds for roads and bridges to force states to comply with Trump's mass immigration deportations. What say you, Trumpsters? The only court rulings you respect are those that support Trump's policies?

'Huge': Supreme Court hands Florida loss in bid to bar undocumented migrants  ruling says states cannot enforce immigration laws. Florida tried to bar an undocumented person from entering the state from another state.

A district judge ruled against theTrump regime's attempt to arbitrarily, without concern for specific situations on the ground, end special temporary protective status for refugees from anywhere. While this may disappoint those who back Trump's plans to get as many brown people out of the US, note that people caught up in that illegal Trump act were also Ukrainians, whose homeland they would have been faced with returning to, is hardly safer, especially given Russia's drone strikes. Another reason given by the judge is significant...agreeing with the plaintiff's argument that the Trump regime was abusing the law because it was attempting to keep brown people from replacing white people, referring to the infamous ideology held by Nazis and US neo nazis. (Jews will not replace us) The report by Newsweek did not contain what evidence there was of the racist nature of Trump position, but that may be worthwhile digging into . 6/13/25 This is a temporary halt on the lower court ruling that the California National Guard control should be returned to the Governor. It is not a ruling on the substance of the lower court judge's ruling. This is a very important issue to follow since the courts now are the only control of federal government overreach, and their bogus argument that the LA demonstrations were a rebellion or invasion that gives the feds justification for ignoring the objections to the deployment by the California governor. One can imagine in other states or in other administrations whether federal militarization without governors' objections, a federal militarized police state, will be allowed.

What Trump plans for his second term and how he will do it

 This is not the prattling of a madman, but it is what he plans to do and the plank he will run on, with stealth or right out in the open for all to see.  He learned much from his first term and is determined not to repeat it.  His plans are straight out: to end democracy as we have known it and to become a dictator within four years.   This is not a fantasy; he could pull it off. Poll: Biden’s standing hits new lows amid Israel-Hamas war (nbcnews.com).Trump: 46%; Biden 44%. Believe him; he has been upfront on it, and it is being used as a sales pitch to recruit his campaign workers now.  The groundwork is already being laid by the misnamed Heritage Foundation, and money is being raised. Donations have surged to groups linked to conservative Project 2025 (nbcnews.com)  The related groups have issue agendas that would roll back any legislation that hurt their special interest groups or ideology.  Project 2025's issues agenda: Analysis Exposes Trumpian Project 2025 as 'Far-Right Playbook for American Authoritarianism' (commondreams.org)  in which it finds their agenda is to elevate Christian nationalism, gut civil service, reverse progress on racial, eviscerate LGBTQ+ rights, restrict reproductive freedom, roll back climate action, end "woke" military, overhaul public education, and curb human rights?  These are the money backers that would come into power as Trump, on his part, replaces those who are disloyal with his appointments, including replacing 50 thousand civil servants who do not pass the loyalty to Trump and MAGA and get purged and using the FBI and DOJ to go indict opponents, and continue to use fear of retribution to any in the federal government who would oppose him, while using the military to put down public demonstrations who object.  The damage to our foreign policy and the fear a Trump repeat would do to national security and the security of our allies is also major. Alarm bells are ringing worldwide..Donald Trump poses the biggest danger to the world in 2024 (economist.com).    Donny Deutsch, 11/20/23 on Morning Joe, the advertising guru, rang a bell with me when he said "to go for the gut" in Biden's campaign. "Trump is dangerous; Biden is safe". This depends on Biden and backers educating voters about why Trump is dangerous and convincing them, as well.  So far, not enough voters have gotten that message and will not, until Biden and his supporters start drawing that contrast as a major theme.

 The Heritage Foundation wants to bring to the end the heritage of our kind of democracy.  It is the diametric opposite of the Federalist Society, which was basically state rightist. Trump's plan is to make the executive branch the governing tool over all the other branches, judiciary and legislative..  His first order of business is to get revenge against those who had and are opposing him.  It has nothing to do with issues or improving citizens' lives. Justice for him means getting revenge against his opponents of the past.  However, those organizations backing his proposals also have an issues agenda that is just plain scary.

Alarm bells are ringing as Biden's support among Hispanics is eroding .  Biden's surprising vulnerability: non-white working-class voters (axios.com)(my own comment: Univision's new owner is aiming to turn Hispanics into Trumpsters on the basis that the ills they are escaping are socialism. The real evil is a dictatorship, socialist or communist or fascist, and the message to Hispanics is that they are trading one dictatorship for another one. (This mindset, fear of "socialism" as in Venezuela and Cuba, played a major motivation for Miami turning red and in Florida as a whole:  Listen up, Hispanics: Trump considers their kind who are here "illegally" as "vermin" who are adulterating "our blood". Are Florida’s Hispanic voters moving more to the right? – WFTV

A personal note: Why am I so interested in the Hispanic community.  My father's grandmother was from Spain, and as a child in eastern Colorado (Brush, Ft. Morgan, Hillrose), his family was bilingual. When I moved to Colorado in 1963, I made it my mission to help Hispanics get a leg up politically and economically in the community, and I began volunteering. My physician husband's closest associate was a Hispanic GP from southern Colorado practicing in Denver. His OB-GYN  practice was bilingual, as well. He was from southeastern Europe and a culture similar to his patients. Every governmental agency I headed or provided community relations services non-profit and private, offered bilingual services, and involved local Hispanics on staff.  I was cabinet and staff for nearly 8 years in the Federico Pena administration when he was Denver's mayor. My largest client as a PR consultant for almost 15 years was auto dealer Mike Shaw, who hailed from the Rio Grande Valley with deep Hispanic roots in Texas. He is a philanthropist at heart, focusing on helping Hispanic youth, among many other disadvantaged, get an education.  A few years ago, he was named National Dealer of the Year by his trade association (NADA) and was the first minority owner of dealerships to be so honored.  We did not share the same political party affiliation, but we shared his philanthropist goals.

The "foul spirit" of those who threaten election officials

As a former elections official and county clerk in Denver, I was fortunate to have been in office at a time when fairness and impartial administrators of elections ruled the day in the latter 1980s and early 1990s. Shortly after I left, the Posse Comitatus raised its ugly head, threatening county clerks to erase tax liens and other tax negatives from their recorded documents. So violent were their threats that El Paso (Colorado Springs) had to have armed guards to protect her. Of course, she did not have the legal power to do what the terrorist demanded.. Those same kinds of violent attempts to terrorize public officials to go against their sworn duty to uphold the Constitution and the laws of their states, counties, and US government played out in Michigan. In 2020, a militia planned kidnapping their governor and their show of armed force at their statehouse. On January 6. 2021, a similar technique of domestic terror, to frighten lawmakers and the Vice President into not signing the certification of Biden's election. Colorado's Secretary of State Jena Griswold is the object of death threats as well. Amen to the opinion column in the Colorado Sun.. As George W. Bush, president at the time of 9/11 so clearly said at Shanksville on the 20th anniversary of that 9/11 attack, in comparing the foreign terrorists who committed that act to the attackers at the capitol January 6, 2020: “There is little cultural overlap between violent extremists abroad and violent extremists at home.But in their disdain for pluralism, in their disregard for human life, in their determination to defile national symbols, they are children of the same foul spirit.” 

 Through public records and interviews, Reuters documented 102 threats of death or violence received by more than 40 election officials, workers, and their relatives in eight of the most contested battleground states in the 2020 presidential contest. Each was explicit enough to put a reasonable person in fear of bodily harm or death, the typical legal threshold for prosecution. Almost all of the 102 threats of violence appeared to be inspired by Trump’s debunked claims that the election was rigged against him.
