What history will remember about the Roberts' 6 to 3 Supreme Court

The Roberts Court will be remembered for three decisions that have had a profound impact on American politics and governance: Citizens United, granting presidential immunity, and removing protections against racial gerrymandering. These decisions will be their legacy. benefiting the powerful at the expense of the well-being of ordinary citizens in their pursuit of life, liberty, and happiness.  

1. Citizens United is a decision that opened the floodgates of secret corporate money to influence who gets elected to public office and controls regulatory and tax policies.  Their considerations now take precedence over the well-being of common citizens, becoming poorer while they become richer. (Citizens United v. FEC (2010)  This decision further protected corruption and the old truism: he who pays the piper calls the tune.

2. Granting of immunity from criminal prosecution while acting in an official capacity. This has resulted in a president who is unconcerned about breaking the law or defying the Constitution.(Trump vs the United States, 2024) It has enabled the President to use fear, revenge, and threats. The result: the executive branch has been able to ignore the separation of powers by cowing Congressional opposition. It has avoided prosecution for any criminal acts, such as becoming rich and powerful from foreign investors, benefiting the President's own pocket and his family. He has also abused the power of pardon, extending that immunity to his staff by promising to pardon them in advance of his leaving office.We now have a lawless and out-of-control president who is taking advantage of the situation to benefit his power and wealth. Decisions he makes are, at a minimum, suspect of benefiting him personally rather than the ordinary people he governs. It gives him the ability to ignore public anger over the affordability of their day-to-day living because he believes he has the autonomous power to govern as he sees fit, and there is no power to stop him.

3. Permitting racist gerrymandering while piously or deceptively claiming they had eliminated race from consideration in the practice of gerrymandering because it is no longer a problem. In one swoop, they negated the civil rights movement of many years ago.( Louisiana v. Callais) , 2026 The result is the elimination of the ability and power of African Americans to have their voices heard in Congress and have the power to protect their civil and voting rights.  The white-dominant state legislatures in former slave states are now hurrying in advance of November midterms to redraw Congressional boundaries to eliminate an estimated 22 seats held by African Americans, moving African American voters into predominantly white-dominated districts.  Their stated reason is to maintain GOP seats and control of Congress this November, despite unfavorable polls.

I have been trying to find proof, too, that those who are not DEI hurt white people. By eliminating DEI throughout the federal government, the result is not to level a playing field, but to give a green light and to remove a barrier to what nationalists most desire, which is giving their race (and mine), already a heady majority, more of an advantage over others. This is a nation with nearly 40% percent of those not white. This is the white nationalists' dream to increase domination of a majority over a minority, a formula for a past and a future of racial conflict. It is not just divisive, it is dangerous for a future we hope will be peaceful and governed by and for all of the people.

What we now have is a country led by an obvious racist and who includes white nationalists in non-elected, powerful, influential positions in his administration. Now his administration is actively recruiting white nationalists for ICE. The US government seems to have a clear message for white nationalists | CNN Politics Whatever could go wrong?

What is clear is that Trump has built his political base and risen to near absolute power on racism, from birtherism to central park 5 to the golden escalator to constantly documented dog whistles to rally his fellow racists, like calling tiki torch carrying neo nazis fine people. Trump has made it clear that the only migrants he welcomes to the US are Norwegians and White South Africans. How much more blatantly obvious can a racist be?

The real shame is that so many Americans share or tolerate his racism.

The other shame is that his racist whisperer is in his ear daily and given a permission slip to proceed. Stephen Miller on his staff has a long history of white nationalism. If anything, Miller's contribution to the Trump regime is his anti-immigrant stance, including using the cruelty of family separation as a tool and in deporting immigrants without due process. He is viewed as an extremist in these sensitive matters. Given his anti-immigrant reputation, I doubt if the Bill of Rights and the civil rights-related amendments would be high on his required list of curriculum topics. Miller is in charge of this ICE project aimed at ridding the country of as many brown people as he can under the pretext migrants are criminals when 70 percent of those they grab have no criminal record.. ..but are brown and are both american citizens and who only committed a misdemeanor of being undocumented. Miller's campaign involves eliminating the birthright citizenship of those born in the US and cleansing them from this country.

Continuing with original post: The 6-3 Supreme Court just gave the green light to ICE to snatch people off the street because they look Hispanic and sound Hispanic. It is racial profiling, pure and simple. I am disgusted. The voice of dissent, Justice Sotomayor, wrote:"We should not have to live in a country where the Government can seize anyone who looks Latino, speaks Spanish, and appears to work a low-wage job," she wrote. "Rather than stand idly by while our constitutional freedoms are lost, I dissent." Trump's Supreme Court is chipping away at civil rights with no explanation other than "it's not our job to set immigration enforcement policy," and we need to call them out. The old warning to anyone who looks Hispanic (or even native Americans), carry your papers ready to show them on the spot, is no real protection as even green card holders and those born here have birth certificates, get detained by ICE. ICE is putting many in holding pens while they "sort it out", and even then, whether the detainee can afford an attorney or even speaks English is a question. Their chance for a "due process" hearing after waiting days in a slammer is a roll of the dice and the hope that some non-profit comes to their rescue.

This is sheer terror, as told to me by my Hispanic friends. Even showing an ICE agent your papers is not always helpful. There are no figures released by the Trump regime that report numbers of those wrongfully detained and even deported, but there are past studies that detail that there were plenty of wrongful detentions dating years before ICE was given a quota ot snatch anyone to make their daily tally. Anecdotal evidence that it is happening now is plentiful if you do a Google search.

6/20/25 I once got into a tangle with a Trumpster regarding the importance of the rule of law. The response was a litany of all of the court rulings against Trump's interest, claiming the anti-Trump decisions, from the 2020 stolen elections to now, were because the judges were all liberal... despite rulings by Reagan and Trump appointees. Yesterday, two court decisions were particularly significant: one upheld the federal government's right to use National Guard troops without the state governor's approval, as seen in the recent California case. The other went against the attempt by the Trump administration to withhold already approved funds for roads and bridges to force states to comply with Trump's mass immigration deportations. What say you, Trumpsters? The only court rulings you respect are those that support Trump's policies?

A district judge ruled against theTrump regime's attempt to arbitrarily, without concern for specific situations on the ground, end special temporary protective status for refugees from anywhere. While this may disappoint those who back Trump's plans to get as many brown people out of the US, note that people caught up in that illegal Trump act were also Ukrainians, whose homeland they would have been faced with returning to, is hardly safer, especially given Russia's drone strikes. Another reason given by the judge is significant...agreeing with the plaintiff's argument that the Trump regime was abusing the law because it was attempting to keep brown people from replacing white people, referring to the infamous ideology held by Nazis and US neo nazis. 6/13/25 This is a temporary halt on the lower court ruling that the California National Guard control should be returned to the Governor. It is not a ruling on the substance of the lower court judge's ruling. This is a very important issue to follow since the courts now are the only control of federal government overreach, and their bogus argument that the LA demonstrations were a rebellion or invasion that gives the feds justification for ignoring the objections to the deployment by the California governor. One can imagine in other states or in other administrations whether federal militarization without governors' objections, a federal militarized police state, will be allowed.

Update 5/14/2025 Here is a problem, however, if whatever civic education is required nationally, the contents can be controlled to suit whatever party or wannabe dictator is in charge of the Department of Education, or whatever parts of the federal government have the power to set policy. One way to deal with that is to tie the exam or course contents to the citizenship test required in the naturalization process as part of any enabling or funding legislation. One problem is that civics is no longer part of achievement testing scores, so it is no longer emphasized in our education system. A passing grade in civics, tied to the citizenship test, should be required for graduation from high school.
