What history will remember about the Roberts' 6 to 3 Supreme Court

The Roberts Court will be remembered for three decisions that have had a profound impact on American politics and governance: Citizens United, granting presidential immunity, and removing protections against racial gerrymandering. These decisions will be their legacy. benefiting the powerful at the expense of the well-being of ordinary citizens in their pursuit of life, liberty, and happiness.  

1. Citizens United is a decision that opened the floodgates of secret corporate money to influence who gets elected to public office and controls regulatory and tax policies.  Their considerations now take precedence over the well-being of common citizens, becoming poorer while they become richer. (Citizens United v. FEC (2010)  This decision further protected corruption and the old truism: he who pays the piper calls the tune.

2. Granting of immunity from criminal prosecution while acting in an official capacity. This has resulted in a president who is unconcerned about breaking the law or defying the Constitution.(Trump vs the United States, 2024) It has enabled the President to use fear, revenge, and threats. The result: the executive branch has been able to ignore the separation of powers by cowing Congressional opposition. It has avoided prosecution for any criminal acts, such as becoming rich and powerful from foreign investors, benefiting the President's own pocket and his family. He has also abused the power of pardon, extending that immunity to his staff by promising to pardon them in advance of his leaving office.We now have a lawless and out-of-control president who is taking advantage of the situation to benefit his power and wealth. Decisions he makes are, at a minimum, suspect of benefiting him personally rather than the ordinary people he governs. It gives him the ability to ignore public anger over the affordability of their day-to-day living because he believes he has the autonomous power to govern as he sees fit, and there is no power to stop him.

3. Permitting racist gerrymandering while piously or deceptively claiming they had eliminated race from consideration in the practice of gerrymandering because it is no longer a problem. In one swoop, they negated the civil rights movement of many years ago.( Louisiana v. Callais) , 2026 The result is the elimination of the ability and power of African Americans to have their voices heard in Congress and have the power to protect their civil and voting rights.  The white-dominant state legislatures in former slave states are now hurrying in advance of November midterms to redraw Congressional boundaries to eliminate an estimated 22 seats held by African Americans, moving African American voters into predominantly white-dominated districts.  Their stated reason is to maintain GOP seats and control of Congress this November, despite unfavorable polls.

Gerrymandering, secret money in campaigns: planting seeds of Democracy's demise

In a country I no longer recognize, the goal once was idealistic: one man, one vote, governed by a populace who believed in facts and were educated, rational thinkers.   It is no longer. Playing dirty pool with congressional boundaries and money, lots of money, given by unknown individuals to buy and pay for political power, has made that a distant dream. Gerrymandering and secret money in campaigns are planting seeds of Democracy's demise. There are ways to begin to fix the problem: 1) nationwide district boundary commissions held to certain standards, and 2) reverse the Citizens United  Supreme Court decision: corporations are not people.

 We cannot change those who fall into cults and under the thrall of demagogues or are self-centered tribalists and racists, driven by desire for more power and wealth, but we can at least recreate a structure of government to provide guardrails and boundaries, to give those who support facts and data, independently, provided we can trust them to have a powerful voice and an education system that provides a civics curriculum based on facts and history.

When our founders established the Constitution in 1789, two features that are so dominant now did not exist then: political parties and the high cost of advertising on modern media.  Failure to update and control gerrymandering and the high cost of running for a political office have planted the seeds for the most significant structural danger to democracy's survival.  We are planting the seeds of democracy's demise by fostering gerrymandering and permitting secret contributions to political campaigns.

Our writers of the Constitution hoped to avoid problems caused by Kings and tyrants, and they devised a kind of government to do it.  It worked pretty well, except for when it didn't, the civil war, and the arrival of political partisanship. Political parties are not even mentioned in the Constitution, but the right for citizens to organize and protest peacefully is core to the First Amendment. The founders had seen the damage political parties could cause in England's parliament, and they did not like it.  They could not stop party formations, and the partisans set out to carve out powers for their organizations, thereby undermining a key goal of democracy: one person, one vote. A single person would vote using reasoning and would not have more power than another. That was the ideal. 

Gerrymandering caused by political parties began in 1812. It was the first blow to one person, one vote when the former Vice President of the US, Eldridge Gerry, then governor of Massachusetts,  reluctantly signed a law permitting congressional district boundaries to be drawn in Massachusetts that looked like a lizzard slamander...so contorted to give the benefit of a safe district to one party to the disadvantage of another. Gerrymandering: The Origin Story | Timeless. Later, gerrymandering was used by segregationists as a way to lump African Americans all in one district, to suppress other districts from having a majority of African Americans.  In its most extreme stages in 2025, these "safe districts" mean that the winner of the primary is guaranteed to win in the 2026 midterms because the geographical area covered by the district was heavily lopsided in favor of the larger party. This makes party discipline very easy: " go along with the boss, or you won"t make it to the general election because we will put up our loyal guy to run against you in the primary even though both of you claim to be loyal to the same party"...and MAGA is always the big one in the recent primary.   Only 27 of 435 Congressional House seats are considered toss-ups. The Competitive Districts that Will Decide Control of the House | Brennan Center for Justice

Now,  Texas has attempted to draw districts that divide up liberal Austin voters into a bunch of districts that mix rural and suburban voters with urban voters, to eliminate turn 5 Congressional districts from blue to red, allegedly at the request of Donald Trump, who fears democrats would win more seats than the GOP in 2026. They are violating the law that said redistricting like this could only happen each decade, a year after the census. (Trump 8 7 2025 then calls for doing the census now....in his drive to "fix" the Congressional elections in November 2026. Trump orders 'new' census that excludes undocumented immigrants)  This is also an exampleTrump's use of racist animus to rationalize his way to trash laws to suit him and his political prospects.. The Texas legislature broke its own constitutional provision to play dirty by politically gerrymandering for a decade. This mid-decade debacle kicked off a storm of California and other blue states to do the same to the GOP and offset this unethical, rule-breaking plot, fighting fire with fire. To try to subvert the Texas legislature so dominated by the GOP, Democrats marched out to stop a quorum needed to pass bills into law. Both parties are guilty of gerrymandering, and the Supreme Court has recently ruled that gerrymandering for political advantage is OK, but it cannot be used to harm racial minorities. Racial gerrymandering was not OK.  The endgame has been in so many safe districts that the party in power in that district denies the political party in the minority a seat in Congress. As a result, in heavily gerrymandered districts, the party in the majority will be the guaranteed winner in November. There are a few districts left that truly are competitive in the November general elections, and all Trump needs to do is threaten to primary any in his party to vote for what he wants. That threat is effective, and we saw it in action to keep MAGA party discipline in the vote on the unpopular Big Beautiful Bill, forcing even reluctant GOP congresspeople who saw the bill hurt their constituents and saw a backlash forming that endangered their political future to fold to Trump's threat of a primary. 

 One approach to fix the problem is to restrict redistricting to once every decade, after the population count.  The other is to establish a non-partisan boundary-drawing commission in every state instead of relying on the state legislature. Most blue states used the commission process to ensure that the number of districts matches the popular vote outcome and are more competitive. This puts blue states at a disadvantage in fighting fire with fire by drawing boundaries to increase their own number of safe districts to offset what red states are doing mid-decade, like Texas is attempting..

The other travesty and blow to democracy was the Citizens United Supreme Court decision, which permitted corporations to contribute money to political groups, and the names of the contributors to the political entity could be hidden.  It once was that campaign contributions were listed separately, and voters could decide who to support based on who was financing the campaign. If you didn't like the donor, you might choose to vote for the opposing candidate. Now, there is no way for voters to know where so many of the big bucks are coming from since corporations and individuals can now donate through political committees, keeping their names hidden. Enabling what is called "dark money".That disclusive secrecy cover needs to be overturned by legislation, but both parties see advantages in not disclosing big-ticket donors' names. While federalizing voter counting and reporting would further damage democracy, at least since individual states can control the election process, some states are getting vote counts via servers not linked to the internet.  This has made it very difficult for foreign hackers to break in and manipulate the election in the county. They have to do it as a state-by-state individual hack of the process.

Disturbed because of the growing crowds supporting the Bernie Sanders/AOC anti-oligarch tour? The rowdy, disruptive attendees at the GOP town halls? When MAGA controls the White House and the majority of Congress and proposes to end democracy as we know it, and Musk is empowered to take a chainsaw to government regardless of human casualties, that is darn radical from the extreme right, so do not be surprised as the left responses in radical terms, too. Extremism begets extremist responses. You should not have been surprised. Biden, by the way, hardly a radical, saw it coming.

Update: 1 27 2025.  The left thinks Biden should be indicted for letting the billionaires get rich during his term, so he calls them oligarchs. Here is where this "indictment" went off the rails. Yes, the ultra-rich billionaires rose, but it took more than 4 years. That is not the issue: the issue is what the billionaires are doing, which is to take over the political power of the nation, having already conquered the economic power. When they merit an office in the West Wing and whisper daily into Trump's ear, that is when they leap from just a billionaire to oligarchdom. In fact, they are even more powerful than the oligarchs supporting Putin, who simply kills them off if they misbehave. The oligarchs put Putin in power, and once there, Putin kicked them out of his government. That may be the fate of the oligopoly under Trump, too. However, Trump is still consolidating his power and needs their help. Our version deserves the title of oligarch because of their political roles, which lifts them above the other extremely rich. They are robber barons, ok. Not just deserving that indictment as monopolists and vulture capitalists, they have branched out by trying to get more tax relief and do away with environmental and consumer protections and social programs to balance off their assault on the treasury. They stand ready and willing to buy any politician who stands in their way. The political power they now have is what needs to be indicted, along with Trump giving them the seat of honor at his table.

I picked up a disturbing line in last Monday's Rachel Maddow show: " We have already lost our democracy. " . My follow-up question is: Can we get it back, and how can we? Ideas, comments? My own thoughts are that on November 5, 2024, 49.9 of voters handed over governance to this country to an autocracy, fed and influenced by oligarchs, and enabled by his Supreme Court to give him immunity from prosecution for criminal acts while performing his official duties.On January 21, 2025, Trump will finalize the takeover by signing 100 executive orders, mostly concerning the implementation of Project 2025, an attempt to place all power in the hands of the executive branch, and reduce the influence of the two other branches by appointees and threats, including violence. The business community is already falling all over themselves bending their knees, ending DEI, and ending fact-checking, mostly out of fear of the abuse of power, from the DOJ and regulatory agencies.
 
Continuing the original 12/17/2024  post:Trump's reliance on oligarch contributions to his campaign and his fawning, and surrounding himself, his cabinet, and his advisers with the current crop of the ultra-rich is ripe for a resistance campaign issue for the midterms. Trump's rule by an administration filled with billionaires that he is planning for his next act is a gift to Democrats as they plot strategy for the midterms in 2026 to get back those working-class voters they lost in 2024. Democrats can and should make a bigger deal of class warfare. It is low-hanging fruit, obvious and visible, and Democrats have a tradition and a credible track record of supporting the middle class ' pocketbook interests.

From my blog posting 1/13/2025 :If we have lost our democracy,  can we get it back? Preserving and restoration of democracy is not an effective pitch to motivate voters. We just got a lesson in that. In fact, at the risk of stating the obvious, what works is understanding and illustrating what voters feel in their lives and directing messaging to their real-life concerns. If democracy is mentioned, it should be that democracy will and can be the best vehicle to reflect and fix the problems important to "ordinary people" rather than an out-of-control kleptocracy and corruption of a Trump autocracy.

The problem is that in 2024, the fear of the loss of democracy was not taken seriously, not understood, nor urgent, and not relevant to everyday life, in spite of the Democrats making Trump's threat to democracy a major campaign issue. Experience is the best teacher if the connection between who and what is at fault can be made and voters are made aware of how they have been hurt. If and when Trump fails to deliver on such promises as rolling back grocery prices, keeping gas at the pump affordable, stopping inflation, and making health care and general living more affordable, will those swing voters, the non-racist motivated ones, be receptive to the message and will the pendulum swing the other way. The trust in Trump, that whatever he does that is good for him is good for you and me too, is a bond that needs to be broken. Trump will continue to win the race-sensitive part of the MAGA block with his anti-DEI, Project 2025 White nationalist agenda, and cruel immigration policies.


GOP priorities regarding tax policy are designed to make the rich richer by extending the tax cuts the rich love. Either they blow the hole bigger than now in the deficit or cut social programs that benefit the middle class and the working poor. Health care, social security and Medicare are targets, among others. This one issue alone is ripe for class warfare. The burning question Democrats need to ask at every opportunity is "How does that benefit whom" and they need to then be ready to point out their alternatives. The GOP has been handed a gift: recovery from COVID-19, putting the breaks on inflation, and jobs for everyone who more or less paid enough to keep up with inflation. Now, let us see what they do with that.

In the meantime, both the executive branch and Congress run by the GOP support and promise policies, including tariffs and immigration, guaranteed to stoke the flames of inflation again. The GOP has to get it right before the midterms for those who say they voted for Trump because of the economy. How the GOP will offset negative fallout will be carrying out their white Christian agenda as planned in Project 2025, which has little to do with Congressional action but relies on executive orders.   Expect every possible failure by the Trump administration on economic policies to blame immigrants who are black and brown or foreign.  So far, this racist, hate approach, fear, and blame the "others" has been a winning strategy for every wannabe and current strongman dictator from Putin to Orban to Erdogan to Trump.  

The most damaging blow to democracy was Citizens United where contributions could be hidden by corporations in lobby and interest groups and political committees. We used to be able to see who contributed. Now they are hidden thanks to the absurd Scotus opinion corporations are people and have rights Musk was brazen. Elon Musk, a person who could fit the definition of an oligarch, has recently become Trump's alter ego. Now that Elon Musk seems to be running the transition and Trump sits in Mar A Lago nodding his head, Musk deserves real scrutiny. Do we really want that powerful influence over Trump by Musk, who is revealing himself as a neo-Nazi sympathizer? He just congratulated the AFD party in Germany for its recent showing and called it the savior of Germany, a party widely recognized by many as a neo-nazi party. It should not come as a surprise.  Trump has given American neo-Nazis a public platform since taking over Twitter (now X).

In the meantime, like never before, social media should be treated as people's opinions but not as a source of credible facts and data.  In 2024,  Democrats raised the fear that oligarchs would damage democracy (https://mufticforumblog.blogspot.com/2024/10/democracy-has-oligarch-problem.html) and instead made combatting MAGA's extreme positions on choice and minority rights and other cultural issues their prime issues.Harris did her best to talk about grocery and gas prices and the high cost of housing and presented some constructive ideas to deal with it, but Trump, the ever real estate promoter and con man, sounded more credible, pointed to low prices pre COVID to make America great again  though he had no plans.  We know how that turned out. We also know he can't deliver, already saying" it is too hard to do it." Now, in Trump.2  it appears that the middle class and working families will also be the victims of the oligarch influence over Trump. 

The rule of billionaires in this second Trump administration is likely to be Trump's Achilles heel. Dems can take aim at those super-rich to the extent that billionaires 1) do not know what wage earners have to do to make ends meet and 2) don't care because they only see public policy good that increases their wealth in tax policy and deregulation. 3) Billionaires often see offsetting the cost of their tax cuts and the damage of doing that by cutting social security health care, feeding the poor, etc, that make the middle-class and working poor's lives easier. Therein lies the reasons Dems can and should engage in class warfare as a contrast to their policies that help wage earners and, the middle class and the needy. They have a track record of advocating, supporting, and protecting the middle class that the GOP does not have. Trump's billionaire appointees plan is a new opportunity ripe for attack not available to Democrats in 2024.

WHAT IS THE DIFFERENCE BETWEEN BILLIONAIRES AND OLIGARCHS  Are all billionaires oligarchs? I have my own take on that. Oligarchs are those who participate in an oligarchy. is an interesting evolution of the usage of the word oligarchs that has roots in economic terms, in how many limited numbers of companies control a "market', or specific sectors of the economy. 

Oligarchs also wield more power than just in business. They are politically involved and control more than one power center, such as the media and political positions, informal or formal.  An oligarch is now most frequently associated with political power.  Not all billionaires are oligarchs, but an oligarch is usually a billionaire or at least a multi-millionaire.
 However, Putin's regime is supported by what Russians call oligarchs...very rich Russians who act on Putin's behalf (or meet unfortunate deaths if they do not). It has become more of a political term than a business/market term.   The term oligarch resembles the US. It has become a political description of a billionaire tied up in political power that resembles the Russian counterparts. I see it in that context. 

 Is Trump an oligarch? If not, he is at least an aspiring one. He acts like one and surrounds himself with bonafide ones to such an extent that at least he appears to treat them as his peer group. Recently, in the passage of the continuing resolution for keeping the government open and his failure to get what he wanted (ending the debt ceiling), he looked like he bowed to his peer, Elon Musk, and Musk's attempt to blow up the bi-partisan deal reached earlier. 

This is a potential issue, and to the extent those like Elon Musk and others hurt ordinary Americans, it needs to be followed closely. It also depends upon the messaging skills of Democrats to make the connection, to date, at best, poor.  The opportunity is there. Not only is it a class clash, but it also has practical consequences that will hurt Americans in their gut of pocketbook issues. If what the oligarchs do appears to be self-serving, wealth-building while the rest of us take it on the chin can become a major issue.  It is especially ripe if what appears to ordinary people is that those like Musk who proposes hurting and cutting out federal programs such as Obamacare and Social Security, consumer protections from abusive business practices and unsafe products are the oligarch's way of offsetting the tax cuts and regulatory requirements.

Is Elon Musk an oligarch? He fits my definition of an oligarch, and he is an example of one who attempts to influence political policy and candidates to benefit him.  Musk controls many sectors, including automotive EVs. social media via Twitter/X , and space exploration.He seems to think at this moment that he also controls Congress, the executive branch, and the GOP.  MAGA seems willing to dance to his tune.  The significance of the House vote on whether to shut down the government or fund it on December 20 was that even Elon could not control that.  Trump looked like he, too, was dancing to Musk's tune, following his lead on the budget ceiling, which both Musk and Trump failed to get it included in the final version.

Musk proposes to cut out the Consumer Finance Protection Bureau so he can avoid regulation when he turns X( formerly Twitter) into a consumer bank and service site. He also wants to destroy reports of Tesla crashes. Bad for business. The finance companies or their loyal consumers? Who speaks for the poor? Not the GOP; not the loudest are the Democrats; bless the ones that do.

WHO SPEAKS FOR THE POOR

When Rep. Paul Ryan first proposed weakening the social safety net in a budget proposal in 20,12    ,the Catholic Bishops called it “immoral”.  That was even before Pope Francis reset priorities of the Catholic Church to care about the poor. Ryan’s newest budget passed by the House this month (and DOA in the Senate), reduces food stamps by $125 billion  and restricts access of the near poor to health care by repealing Obamacare and reducing Medicaid.If his first proposal was immoral, the 2014 version  is beyond immoral. Who is speaking for the poor these days?,

  Not The GOP, many of whom oppose even raising the minimum wage, so low now even full time workers live in poverty. Not Republicans who support    laws making  it harder for the poor without affordable  and easy access to drivers’ licenses and birth certificates or convenient voting hours to raise their voices .Not the GOP House members including the GOP Colorado Representatives who voted for Ryan budget this month, that would have  cut  food stamps while cutting  taxes for the rich.

 Growing  up in Oklahoma in the 1950’s, I  heard many  rationalize opposing government assistance  by blaming  the poor themselves,  opining African Americans  were lazy or undeserving.. Racist attitudes coloring opposition to  welfare still linger into recent times  per  a study of  many public opinion polls reviewed by Arizona State University.

 Pres. Johnson’s  War on Poverty  and civil rights legislation were  the reaction  to the injustice and  fueled by the long hot summer riots of the late 1960’s . America learned that the poor could get attention even if they did not have a political voice. But there were also abuses as some gamed the  new welfare system .

  Reality check: Welfare reform in the 1990’s  put more  to work. Those left receiving  food stamps now, per the US Department of Agriculture, are mostly kids  (47 percent are under age 18)and elderly (8%). . Three-quarters of food stamp recipients are families with children.    
  The charity community is  doing what they can , but sometimes the food bank cupboard is bare..Hunger plagues 1 out of 5 kids who do not know where the next meal is coming from and government through school lunch programs and food stamps make up part of the  difference.  

 Many of the states with the largest number of poor have  state houses dominated by the GOP yet whose budgets are the most dependent on federal money for social programs. They have  the greatest need and the least will to provide .Leaving   states to use their own resources with federal block grants masking diminished federal contributions to Medicaid, as Ryan’s budget does, would  further divide this country  between the have  and  have nots..

 Even the Democratic Party has  focused priorities  on issues supporting the middle class.
 The voice of the poor was further overwhelmed by recent Supreme Court decisions that  gave corporations the same right as individuals to contribute political campaigns (Citizen's United), and a recent decision (McCutcheon v FEC) that made it much easier for the wealthy to  spread their  influence around.

So who is left as the strongest voice for the poor? Some in the  faith community and Pope Francis and God bless them.
